Regional Chair Kolb called the meeting of Regional Council to order at 9:43 a.m. in the Council Chamber, Regional Administrative Headquarters, 10 Peel Centre Drive, Brampton.

That the agenda for the August 2, 2007 Regional Council meeting be amended to include a presentation by James Carrick, Manager, Traffic Engineering, Environment Transportation and Planning Services, Region of Peel and Philip Weber, Project Manager, Ourston Roundabouts Canada, providing an overview of the proposed use of roundabouts in the Region of Peel, to be dealt with as Item 5c;

And further, that the agenda for the August 2, 2007 Regional Council meeting be approved, as amended.

a) Toby Lennox, Vice President, Corporate Affairs, Greater Toronto Airports Authority (GTAA), Providing an Update Regarding the GTAA Master Plan for Toronto Pearson International Airport (TPIA)

Received 2007-965

Toby Lennox, Vice President, Corporate Affairs, Greater Toronto Airports Authority (GTAA), advised Regional Council that the GTAA Master Plan is being updated to address significant re-structuring and changes in the airline industry and air transportation sector since the completion of the plan seven years ago. The GTAA will be examining and establishing the timing of future development at the Toronto Pearson International Airport; exploring how existing facilities can be optimized; and, exploring reliever airport capacity options once the capacity at Pearson is reached. GTAA representatives are currently in the process of sharing information and consulting with several stakeholders and the community at large.

b) Mark Nantais, President, Canadian Vehicle Manufacturers' Association Requesting that Regional Council Pass a Resolution Calling Upon the Federal Government to Phase Out the Federal ecoAuto Rebate Program

That the presentation by Mark Nantais, President, Canadian Vehicle Manufacturers’ Association requesting that Regional Council pass a resolution calling upon the federal government to phase out the Federal ecoAuto Rebate Program be received;

And further, that staff report to a future General Committee meeting with a proposed Regional position with respect to the Federal ecoAuto Rebate Program.

Mark Nantais, President, Canadian Vehicle Manufacturers' Association, provided information on the potential negative impacts on the auto industry, consumers and communities in Ontario as a result of the Federal ecoAuto Rebate Program and requested support in lobbying the Federal government to reconsider the program.

James Carrick, Manager, Traffic Engineering, Environment Transportation and Planning Services and Philip Weber, Project Manager, Ourston Roundabouts Canada,advised that staff are proceeding with the detailed design of the first roundabout within Peel at the intersection of Dixie Road and Olde Baseline Road, in the Town of Caledon.

Council was advised that statistics on roundabouts show: a reduction in the number of collisions that they require low maintenance; and they reduce delays, which in turn reduces the environmental impacts of fuel consumption and vehicle emissions.

HS-A1. User Fee Amendment for Child Care

That the Child Care User Fees proposed in Appendix I to the report of the Commissioner of Human Services and General Manager, Peel Living, dated July 11, 2007, titled “User Fee Amendment for Child Care”, be approved;

And further, that the User Fees contained in Appendix I to the subject report take effect on September 1, 2007;

And further, that the Fees By-law be amended to include the User Fees in Appendix I to the subject report;

And further, that the Fees By-law be amended to reflect the calculation of Child Care subsidized fees under R.R.O. 1990, Regulation 262 made under the Day Nurseries Act, as amended by O. Reg 505/06, effective January 1, 2007, as outlined in Appendix I to the subject report;

And further, that the necessary by-law be presented to Regional Council for enactment.

HS-B1. Literacy Month in Peel - September 2007

WHEREAS the Region of Peel – Ontario Works, the Region of Peel – Childrens’ Services and the Peel-Halton-Dufferin Adult Learning Network have partnered to raise awareness of events promoting literacy and lifelong learning in Peel throughout the month of September 2007;

AND WHEREAS, each year the United Nations Educational, Scientific and Cultural Organization (UNESCO) c elebrates International Literacy Day on September 8 th to highlight the importance of literacy to individuals, communities and society;

AND WHEREAS, over the last year more than 300,000 hours of training to more than 2,400 adult learners were delivered by service providers;

AND WHEREAS, the Regional Values include a supportive and respectful environment, teamwork and quality service which are integral in partnerships and providing quality literacy services throughout the Region;

AND WHEREAS, Success By 6 Peel recognizes literacy as a basic need for successful school entry as well as the foundation for future learning and social/economic development;

THEREFORE BE IT RESOLVED, that the month of September 2007, be proclaimed “LITERACY MONTH” in the Regional Municipality of Peel.

And further, that the Proposed Set Fines, as generally outlined in Appendix II to the subject report, be approved;

And further, that the Proposed Set Fines schedule for Waste Collection By-law infractions be submitted to the Regional Senior Justice of the Ontario Court of Justice for approval;

ETP-A4. Improvements to the Peel Compost Curing Facility, Capital Project 07-6655 - Town of Caledon, Ward 2

That staff be authorized to enter into a letter of intent with W. L. Gore & Associates, Inc. to allow for development of detailed designs and costing information related to the potential purchase of a GORE TM Cover System for use at the Peel Curing Facility at a cost of €100,000 (or an estimated $144,000 CDN, excluding applicable taxes);

And further, that staff be authorized to enter into direct negotiations with Lonsdale Consultants to undertake the civil design works and preparation of cost estimates at an estimated cost of $75,000 (excluding applicable taxes);

And further, that staff report back to Regional Council with recommendations on the potential use of the GORE TM Cover System after conducting necessary due diligence and consulting with local area residents;

And further, that funding in the amount of $219,000 be set up under Capital Project 07-6655, from R1010 Waste Management Capital Construction Reserve to fund the project;

And further, that staff be authorized to enter into a three month emergency contract for curing immature compost with All Treat Farms Limited at a cost of $1.9 million funded from the Current Cost Centre WW70340, and in the case of a deficit, a draw from the Waste Reserve will be requested.

That the Region of Peel enter into negotiations with Infilco Degremont Inc. (IDI), KMK Consulting/Black & Veatch Corporation and Kenaidan Contracting Ltd. for the supply and design of the mercury control system, and the design, contract administration and the installation of mercury control system at the G.E. Booth (Lakeview) Wastewater Treatment Facility;

And further, that upon successful negotiations, the Chief Administrative Officer be authorized to approve the awards;

And further, that funds in the amount of $7,000,000 be transferred from Capital Project 02-2924 to Capital Project 03-2941 and $1,000,000 be transferred from Capital Project 02-2925 to Capital Project 03-2941, with funding sources remaining intact;

And further, t hat the budget for Capital Project 03-2941 be increased by $10,000,000 financed from the South Peel Wastewater Reserve DC-R351, $6,800,000; from the Wastewater Capital Financing Stabilization Reserve, R0242, $2,100,000; and from York Region Recoveries, $1,100,000;

And further, that the required documents be executed by the Regional Corporation's duly authorized signing officers.

ETP-A6. Construction of Sanitary Sewer on Creditview Road, South of Regional Road 6 ( Queen Street West), Capital Project 07-2701, Document Number 2007-590N - City of Brampton, Ward 6

That staff be authorized to negotiate an Agreement with the Trustee for the Credit Valley Secondary Plan Block 5 Landowners Group to permit the construction of a 250mm (10 inch) diameter sanitary sewer from Regional Road 6 (Queen Street West) to approximately 1500 metres (4,921 feet) south on Creditview Road;

And further, that staff be authorized to enter into direct negotiations with the Trustee for Credit Valley Secondary Plan Block 5 Landowners Group for the construction of the sanitary sewer under the approved Capital Project 07-2701 at the lower of the lowest tendered price or budget unit value not to exceed $1,300,000, in accordance with the Purchasing By-law 37-2007;

And further, that a copy of the report of the Commissioner of Environment, Transportation and Planning Services, dated July 7, 2007, titled “Construction of Sanitary Sewer on Creditview Road South of Regional Road 6 (Queen Street West), Capital Project 07-2701, Document 2007- 590N - City of Brampton, Ward 6” be forwarded to the City of Brampton.

ETP-A7. Local Improvement Project, Proposed Construction of Sanitary Sewer on South Sheridan Way, Capital Project 07-2705 - City of Mississauga, Ward 2

Seconded by Councillor Morrison;

That a 250 mm (10 inch) diameter sanitary sewer be constructed on South Sheridan Way from Kiran Court to approximately 100 metres (328 feet) west of Kiran Court, at a total estimated cost of $127,000 (excluding applicable taxes), under new Capital Project 07-2705, in the City of Mississauga, Ward 2, as a local improvement;

And further, that total funding to cover the Region of Peel portion of the works in the amount of $89,294.50 be allocated from the Wastewater Capital Financing Stabilization Reserve (R0242) under Capital Project 07-2705;

And further, that the portion allocated to the property owners in the amount of $37,705.50 be set up as an external recovery, under Capital Project 07-2705, and be collected as a special charge;

And further, that these actions will not affect the debt capacity of the Region, as this type of financing is considered “self liquidating” by the Province of Ontario;

And further, that the necessary by-law be presented to Regional Council for enactment on September 13, 2007, authorizing the undertaking of the works under the Local Improvement ChargesPriority Lien Status Regulation O. Reg. 586/06, filed under the Municipal Act, 2001, and the imposition of a sanitary sewer frontage rate of $450.00 per metre ($137.15 per foot), that will be due and payable at the completion of construction;

And further, that notice of the intention to pass a local improvement construction by-law be given in accordance with O. Reg. 586/06;

And further, that the benefiting property owners be charged annually for 15 years, including an interest rate which shall be determined at the time a by-law is enacted;

And further, that those property owners be given the opportunity to commute the special charge by advance payment at any time during the 15 year period;

And further, that the Regional Clerk forward a copy of the report of the Commissioner of Environment, Transportation and Planning Services, dated July 23, 2007, titled “Local Improvement Project, Proposed Construction of Sanitary Sewer on South Sheridan Way, Capital Project 07-2705 - City of Mississauga, Ward 2” to the City of Mississauga;

And further, that following the Committee of Revision, the Region of Peel send a “Notice to Amend” the tax rolls of the affected owners to the City of Mississauga for appropriate action.

ETP-A8. Watermain on Hurontario Street, South of Bovaird Drive, Capital Projects 02-4090 and 07-1302, Document Number 2004-611T - City of Brampton, Wards 1 and 5

That the existing contract (Document 2004-611T) for the widening of Regional Road 10 (Bovaird Drive) from Sunforest Drive to McLaughlin Road, awarded to Pave Al Limited, be extended in order to extend the existing watermain on Hurontario Street in the estimated amount of $100,000 (excluding applicable taxes), under new Capital Project 07-1302, for a total commitment of $9,655,000 (excluding applicable taxes), in accordance with Purchasing By-law 37-2007;

And further, that the existing purchase order for design and engineering services between the Region of Peel and Giffels Associates Limited related to Capital Project 02-4090 be extended to provide for engineering services related to the watermain design in the estimated amount of $10,000 (excluding applicable taxes), for a total commitment of $1,793,850 (excluding applicable taxes), under Capital Project 07-1302 in accordance with Purchasing By-law 37-2007;

And further, that funding in the amount of $110,000 be provided to Capital Project 07-1302, financed from Capital Project 07-1000 – Unallocated Funds.

Construction Ltd. in the estimated amount of $908,090 (excluding applicable taxes), under Capital Project 05-4248, in accordance with Purchasing By-law 37-2007 ;

And further, that additional funds in the amount of $567,000, be provided to Capital Project 05-4248 financed from the Contribution Development Charges Regional Roads Res erves (R3505);

And further, that the required documents be executed by the Regional Corporation’s duly authorized signing officers.

And further, that Regional staff be authorized to proceed with negotiating standard co-location agreements with the Cities of Mississauga and Brampton;

And further, that Regional staff be authorized to enter into discussions with the City of Brampton to explore best options for a satellite station at the current Paramedic site at 52 Bramalea Road;

And further, that Regional staff be authorized to enter into discussions with the area municipalities to develop a co-location financing model and bring forward options and provide any necessary updates to the Emergency and Protective Services Committee meeting scheduled to take place on October 11, 2007;

Three Readings

By-law 71-2007: A by-law to authorize the construction of a watermain on Highway 10 in the Town of Caledon, and undertake such work as a local improvement.

By-law 72-2007: A by-law to repeal by-law 48-2001 and establish a by-law to create a Tax Rebate Program for Registered Charities.

By-law 90-2007: A by-law to designate a southbound left turn lane, a southbound left and through lane, and lane restriction for heavy trucks, at the intersection of Regional Road 17 (Cawthra Road) at Lakeshore Road and to amend By-law Number 57-2005 being a by-law to regulate traffic on roads under the jurisdiction of the Regional Municipality of Peel.

By-law 91-2007: A by-law to regulate the collection of waste in the Region of Peel.

By-law 92-2007: A by-law to amend By-law 43-2002 titled the “Fees By-law”, as amended by By-law 21-2007.
