Chair Kolb presented the Paul Schram Memorial Award to Maura Medeiros, Emergency Communicator, Peel Regional Police, for her bravery in assisting a Mississauga resident during a car hijacking.

b) Councillor Paul Palleschi Presenting a Donation to the Toys for Tots Program

Councillor Palleschi advised that he has raised $16,000 from fundraising this year for various charities and that he is donating $2,000 of those dollars to the Toys for Tots Program. Superintendent Boychuck from the Peel Regional Police was in attendance to receive the donation on behalf of the program.

United Way Fundraising Campaign (Oral)

The Chief Administrative Officer updated Council on the 2002 United Way Fundraising Campaign which was headed up by the Public Works Department. He advised that the Region has surpassed its goal of $157,000. He thanked Regional staff for their efforts and their generous contributions in raising $164,000, thus far.

That the contract for Architectural Services pertaining to the development of the Joint Use Regional and Police Facility in accordance with Document Number 2002-332P be awarded to WZMH Architects in the estimated amount of $1,920,000 exclusive of disbursements and all applicable taxes;

And further, that funds for this award be provided from Cost Centre 01-7035;

And further, that staff be authorized to approve such changes, additions and or deletions as may be reasonably required for the proper management of this project, providing that they are within the approved capital budgets for the project;

And further, that staff be authorized to negotiate and execute all contracts and agreements necessary to proceed with the development of the project up to but not including construction, which will be subject to further Council authorization;

RECOMMENDATION GC-227-2002:

That in accordance with the Ontarians with Disabilities Act, 2001 (ODA), the Region of Peel establish an Accessibility Advisory Committee to consult on the creation and maintenance of an annual municipal accessibility plan;

And further, that the terms of reference for the Region of Peel Accessibility Advisory Committee (AAC), as outlined in the report of the Commissioner of Corporate Services and Regional Solicitor, dated November 11, 2002, titled "Region of Peel Accessibility Advisory Committee - Terms of Reference", be approved;

And further, that the composition and process for the selection of members of the AAC as described in the subject report, and in accordance with the ODA, be initiated by staff;

RECOMMENDATION GC-230-2002:

That the Region of Peel reimburse the Fletcher's Meadow Developers Group for construction costs included in the approved 2000 to 2002 Capital Budget Program, in the amount of $3,262,118.50 for oversized sanitary sewers and watermains constructed in conjunction with the development of lands within the Fletcher's Meadow Secondary Plan, in accordance with the front-ending arrangements in the executed Subdivision Agreements and Letters of Undertaking;

And further, that upon completion of the oversized sanitary sewers and watermains, the Region of Peel reimburse the Fletcher's Meadow Developers Group for construction costs included in the approved 2002 Capital Budget Program in the amount of $1,506,870.00 for oversized sanitary sewers and watermains currently under construction, in conjunction with the development of lands within the Fletcher's Meadow Secondary Plan, in accordance with the front-ending arrangement in the executed Subdivision Agreements and Letters of Undertaking;

And further, that upon approval of the 2003 Capital Budget, the necessary funding in the amount of $876,302.00 be reimbursed to the Fletcher's Meadow Developers Group for oversized sanitary sewers and watermains constructed and currently under construction, in conjunction with the development of lands within the Fletcher's Meadow Secondary Plan, in accordance with the front-ending arrangement in the executed Subdivision Agreements and Letters of Undertaking;

And further, that funds for all projects listed are available from R3530 (Development Charge Regional Water Reserve), R3525 (Development Charge Regional Wastewater Reserve) and R3625 (Development Charge Regional Wastewater - OBL Reserve).

And further, that the total honorarium be $170,000 ($85,000 for each of the unsuccessful compliant proponents) with $124,950 being Peel's share for the Airport Road Reservoir and Pumping Station, Project Number 02-1916;

And further, that the required documents be executed by the Region's duly authorized signing officers.

RECOMMENDATION GC-237-2002:

That the Peel Organics Demonstration Project in areas of Brampton, Mississauga and Caledon be extended from January 31, 2003 to April 30, 2005, with no immediate changes to the existing collection service;

And further, that staff continue to investigate the potential for expansion outside of the Peel Organics Demonstration Project areas;

And further, that the 2003 Waste Management Budget be amended to include an additional $48,000 to be provided to Project Number 98-6300 financed from the New Capital Waste Reserve (R1145).

Whereas, the Regional Municipality of Peel has negative markets for reusing coloured glass collected in the Region's Blue Box program;

And whereas, Council supports a deposit and return system for Liquor Control Board of Ontario (LCBO) containers;

Therefore be it resolved, that the Council of the Regional Municipality of Peel supports a Private Members Bill, The LCBO Deposit and Return Act, to require the Liquor Control Board of Ontario (LCBO) to implement and administer a deposit and return system for all liquor containers sold in Ontario.

PL-B1. Oak Ridges Moraine Conservation Plan - Achieving Conformity

RECOMMENDATION GC-241-2002:

Whereas the Provincial government has committed to developing and maintaining a data management system to collect, store, update and share natural heritage, water resources and geotechnical information needed to interpret, apply and monitor the policies of the Oak Ridges Moraine Conservation Plan (ORMCP);

And whereas the Provincial government has committed to updating existing technical guidelines and developing new ones as required to help the users of the ORMCP to better understand, interpret and implement the policies of the Plan;

And whereas primary responsibility for detailed implementation of the ORMCP rests with the Town of Caledon and any local implementation guidelines are most appropriately developed by the Town of Caledon in consultation with appropriate stakeholders;

And whereas the Town of Caledon requires the Regional ORMCP Conformity Amendment to provide sufficient flexibility to allow the Town to explore, through the preparation of the local ORMCP Official Plan Conformity Amendment, alternatives for addressing and resolving various detailed policy issues and concerns;

And whereas further clarification is required regarding the jurisdiction of the Ontario Municipal Board with respect to ORMCP conformity issues after the initial round of conformity amendments have been approved by the Minister;

And whereas these matters require further discussion between Regional Councillors and planning and legal staff of the Region of Peel and Town of Caledon prior to the draft Regional ORMCP Conformity Amendment being released to the public for review;

Therefore be it resolved that Planning staff be directed to revise the preliminary draft Regional ORMCP Conformity Amendment to delete proposed sections 7.2.6.10, 7.6.2.11 and 7.9.2.7 and to delete the second last sentence of proposed section 2.2.9.3.5 c);

And further, that Regional planning staff be directed to hold a series of meetings with interested Regional Councillors and planning staff from the Town of Caledon to ensure that issues of local flexibility and the Ontario Municipal Board's jurisdiction with respect to the ORMCP are resolved and the draft Regional ORMCP Conformity Amendment revised accordingly, prior to the release of the draft conformity amendment to the public for review.

That all development applications be circulated to the Halton-Peel District Health Council for comment and their comments be included in the report to the Regional Council;

And further, that we again appeal to the Government of Ontario to reestablish the Development Levy for Hospitals;

And further, that a report be presented to Regional Council in January 2003 with the necessary data to support this request.

F2. Development Charges in Peel Region

RECOMMENDATION GC-243-2002:

Whereas there is a need for the Region of Peel to negotiate with the Province of Ontario to change the criteria for development charges, prior to the five-year review;

Therefore be it resolved that a report be presented to the first Regional Council meeting in January on the changes that need to be made with respect to development charges to meet the community needs for capital projects, for all levels of services, including hospitals and school buildings;

And further, that the Province of Ontario be requested to fund all available beds.

That Council approve third year funding totalling $224,450 for Regional Community Programs' six initiatives, as set out in Appendix 1 of the report of the Commissioner of Social Services, dated November 1, 2002 titled "Community Programs Funding 2002, Funding for Six Collaborative Initiatives Supporting Youth and Families";

And further, that $199,450 of the total funding be expensed to CF10101 account 56110, in the amount of $131,249, and to CF00012 account 56743, in the amount of $68,201 as part of the approved Ontario Works 2002 Current Budget;

And further, that the balance of funding in the amount of $25,000 be expensed to CF00012 account 56743 to be financed from the Working Funds Social Services Grants Reserve R1260.

By-law 63-2002: A by-law to accept, assume and dedicate lands for public highway purposes.

By-law 64-2002: A by-law to requisition from the lower tier municipalities a sum not exceeding 50 percent of the amount that in By-law 21-2002 was to be raised in each lower tier municipality before the adoption of the final Regional estimates for the year 2003.
