That electricity generated by the Britannia Landfill Gas Utilization Facility, which was previously approved by Council Resolution 2001-907, be used at the Region of Peel's Lakeview Wastewater Treatment Plant;

And further, that approval be given to purchase the power from Integrated Gas Recovery Services at a fixed price of $65.55 per megawatt hour for the first five years and thereafter annually adjusted according to the Consumer Price Index for each of the additional 15 years.

And further, that a Selection Committee composed of three members of Regional Council, the Chief Administrative Officer and the Commissioner of Corporate Services and Regional Solicitor be struck to select the next Regional Clerk.

RECOMMENDATION GC-152-2002:

That the implementation strategy proposed in the report of the Commissioner of Corporate Services and Regional Solicitor, and the Commissioner of Social Services, dated, August 8, 2002, titled "Ontarians with Disabilities Act, 2001", be endorsed;

And further, that a copy of the subject report be provided to the Honourable Carl DeFaria, Minister of Citizenship for the Province of Ontario for his information as to how the Region of Peel is actively engaged in the implementation of the Ontarians with Disabilities Act (the "Act") generally and in establishing an Accessibility Advisory Committee in particular, both of which processes will be advanced but not completed prior to the September 30, 2002 coming into force of parts of the Act affecting the Region of Peel;

And further, that a copy of the subject report and related Council resolution be provided to the Credit Valley Conservation (CVC) Authority and the Clerks of the City of Mississauga, City of Brampton, and the Town of Caledon, for their information.

RECOMMENDATION GC-153-2002:

That the Peterborough Flood Relief Committee's request for donations for relief to residents of the City of Peterborough affected by their record breaking rainfall in June of 2002 be communicated to the residents of the Region of Peel through local media;

And further, that Peel residents be advised of methods of contributing to the Peterborough Flood Relief Committee Fundraising Campaign on an individual basis.

That The Regional Municipality of Peel enter into an Amended Reciprocal License Agreement with the Greater Toronto Transit Authority (GO Transit) and the City of Mississauga to permit the City of Mississauga to use the GO Transit bus loop located on the Meadowvale Water Tower site;

And further, that the Consent to Enter Agreement dated August 14, 2002 between the Greater Toronto Transit Authority (GO Transit), the Corporation of the City of Mississauga, and the Regional Municipality of Peel be approved.

HS-A1. Mandatory Use of Booster Seats for Children Aged 4-8 Years

RECOMMENDATION GC-158-2002:

That Regional Council request the Ontario Ministry of Transportation (MTO) to amend the Highway Traffic Act to mandate that children 18kg (40lbs) to 27kg (60 lbs) be required to use booster seats when travelling in motorized vehicles.

HS-B1. World Breastfeeding Week 2002 - October 1 to 7, 2002

RECOMMENDATION GC-159-2002:

Whereas the week of October 1 to 7, 2002 is World Breastfeeding Week in Canada and breastfeeding is promoted by UNICEF, The World Health Organization (WHO), The World Alliance for Breastfeeding Action (WABA), Health Canada, Infant Feeding Action Coalition (INFACT Canada), and the Canadian Pediatric Society;

And whereas the health and developmental benefits of breastfeeding are many for both mothers and children;

And whereas the provincial goal of 50% of infants breastfeeding until six months of age has not yet been achieved in Peel;

And whereas many women need immediate community support and information to breastfeed successfully;

And whereas breastfeeding needs strong promotional and support strategies to counteract aggressive advertising of breast milk substitutes;

Therefore be it resolved that the week of October 1 to 7, 2002 be proclaimed World Breastfeeding Week in the Regional Municipality of Peel.

RECOMMENDATION GC-160-2002:

That Regional Council confirm that the recommendations outlined in the Integrated Services For Children Information System - Healthy Babies Healthy Children (ISCIS-HBHC) Release 2.0 Privacy Impact Assessment attached as Appendix 1 to the report of the Commissioner of Health and Medical Officer of Health, dated August 22, 2002, titled "Integrated Services for Children Information System's (ISCIS) Privacy Impact Assessment" have been reviewed;

And further, that Regional Council confirm that a plan to address the recommendations outlined in the ISCIS-HBHC Release 2.0 Privacy Impact Assessment is being implemented.

RECOMMENDATION GC-162-2002:

Whereas the Children's Services Division provides leadership in the effective planning, management, development and delivery of a range of high quality child care services in the Region of Peel;

And whereas the Region of Peel operates 11 Child Care Centres with 761 licensed spaces throughout Brampton and Mississauga and provides financial assistance so that families can access care in 3604 spaces in over 350 child care and recreation programs throughout Peel;

And whereas the Region of Peel's Child Care Centres offer children an inclusive learning environment where they develop intellectually by receiving a quality early childhood education;

And whereas access to and informed choices about child care allow parents to continue to work or increase skills through training and education;

And whereas children are vital to the growth and spirit of communities;

Therefore, be it resolved that the week of October 19 to 27, 2002 be proclaimed Week of the Child in the Regional Municipality of Peel.

Seconded by Councillor Morrison;

Whereas the Municipal Act RSO 1990, as amended, stipulates that the seat of a member of Council becomes vacant if the member is absent from the meetings of Council for three successive months without being authorized by resolution of the Council entered in its minutes;

And whereas, Regional Chair Emil Kolb for health reasons has been required to be absent from meetings of Regional Council since July 11, 2002;

And whereas, it is the wish of this Council that the office of Regional Chair Emil Kolb not be jeopardized due to his illness;

Therefore be it resolved, that Regional Chair Emil Kolb be authorized to be absent from meetings of Council for more than three successive months.

a) Impacts of Growth in the Region of Peel on Policing Requirements and on the Police Budget

Seconded by Councillor Mullin;

That in view of police costs being a major impact on the Regional Budget as a whole, it is essential that our Police Force is equipped to handle the growth in the City of Mississauga and the City of Brampton;

Therefore be it resolved, that the Region of Peel, in processing development applications, report on the impact of the Police Budget such as indicating police requirements regarding staff.

That the Offer to Sell Agreement from Innerville Holdings Inc. and Tupperville Holdings Inc. for the fee simple purchase of lands described as Part of Lots 4, 5, 6, Plan 347, City of Brampton, Regional Municipality of Peel for the purchase price of $65,000.00 and for the temporary easement described as Part of Lots 4, 5, 6, Plan 347 City of Brampton, Regional Municipality of Peel for the purchase price of $1,300.00, plus taxes and costs, be approved;

And further, that title to the lands and temporary easement be directed to the Corporation of the City of Brampton;

And further, that the funds for the transaction be provided from Public Works Project Number 00-4225 which are included in the cost-sharing agreement between The Regional Municipality of Peel and the Corporation of the City of Brampton.

That The Regional Municipality of Peel as Tenant enter into an Offer to Lease Agreement dated July 25, 2002 with Glen Erin Commons Limited as Landlord for approximately 2,400 square feet (222.96 square metres) of space within the Glen Erin Commons Mall located at 3476 Glen Erin Drive in the City of Mississauga;

And further, that the funds for and associated with the Lease Agreement be provided from Cost Centre PA20200;

And further, that the Office of the Regional Solicitor be authorized to execute all necessary notices and other documents to register Notice of Lease.

RECOMMENDATION GC-166-2002:

That The Regional Municipality of Peel, as purchaser, enter into an Agreement of Purchase and Sale with the Corporation of the City of Brampton, as vendor, for the fee simple purchase of lands described as Part of Lot 5, Concession 4, East of Hurontario Street, City of Brampton (formerly Township of Chinguacousy), Regional Municipality of Peel, and more particularly described as Part 1 on draft reference plan 43R-27493 by J.D. Barnes Limited for a purchase price of $1,750,000.00, plus taxes and costs, on the terms and conditions satisfactory to the Commissioner of Housing and Property and General Manager, Peel Living and the Office of the Regional Solicitor;

And further, that the executed Offer to Purchase Agreement be forwarded to the City of Brampton for presentation to Brampton City Council;

And further, that the funds for the transaction be provided from Cost Centre 01- 7035.

RECOMMENDATION GC-167-2002:

That the Offer to Sell Agreement from Gordon Bolton Fawcett, as the Owner, for the fee simple purchase of the lands and buildings described as Part of Lot 18, Concession 1, East of Hurontario Street, City of Brampton (formerly Township of Chinguacousy), Regional Municipality of Peel, as described in Instrument No. RO1178887, PIN 14235-0012, and known municipally as 3056 Mayfield Road, Brampton, Ontario for a purchase price of $330,000.00, plus taxes and costs, be approved;

And further, that the funds for the transaction be provided from Public Works Project Number 01-4830.

2. Staff Reports

a) A proposed or pending acquisition of land for municipal purposes

That to permit draft approval of Plan of Subdivision No. 21T-95028B the Springdale Community Transportation Development Cap (the "Transportation Cap") be increased from 13,000 units to not more than 13,650 units conditional upon:

  • Chinguacousy Farms Limited completing the property sale transaction with the Ministry of Transportation (MTO) for the lands necessary to provide for the extension of Highway 410 including the lands required for the construction of Sandalwood Parkway from Great Lakes Drive to Heart Lake Road (the "Sandalwood Extension");

  • The completion of the construction of the intersection improvements at Sandalwood Parkway/Heart Lake Road, Heart Lake Road/Birchcliffe Drive, and at the Highway 410/Bovaird Drive northbound ramp, as described in the iTRANS summary of findings and recommendations as shown in Appendix IV; and

  • The City of Brampton endorsing the increase in the Transportation Cap to not more than 13,650 units, and the commencement of construction of the Sandalwood Extension prior to building permits being issued within the Plan of Subdivision No. 21T-95028B;

And further, that the joint In Camera Report of the Commissioner of Planning and the Commissioner of Public Works, dated September 19, 2002, titled "Highway 410 Extension-Chinguacousy Farms", be made public and provided to the City of Brampton and the MTO, for consideration and to the City of Mississauga, and the Town of Caledon for information;

And further, that Chinguacousy Farms Limited be allocated no more than 650 units within this revised cap.

That By-law 50-2002 to confirm the proceedings of Regional Council at its meeting held on September 19, 2002, and to authorize the execution of documents in accordance with the Region's by-laws relating thereto, be given the required number of readings, taken as read, signed by the Regional Chair and the Regional Clerk, and that the Corporate Seal be affixed thereto.
