A by-law to provide for the Regional Corporation's consent to permit encroachments onto parts of Regional Road 22 (Old Church Road) in the Town of Caledon

WHEREAS Tratod Properties Inc, the owner of the lands and premises described as Part Lots 1 and 2, Townline, Plan ALB-5, designated as Part 2 on Reference Plan 43R-35639, Town of Caledon (formerly Township of Albion), Regional Municipality of Peel, has requested permission to maintain and use certain structures or improvements upon the public highway (the "Encroachment");

AND WHEREAS, pursuant to Section 11(3) of the Municipal Act, 2001, S.O. 2001, c.25, the Regional Corporation may pass a by-law respecting encroachments on Regional roads;

AND WHEREAS, the Council of the Regional Corporation has by resolution passed on the 11h day of September, 2014 authorized the enactment of a by-law authorizing the Encroachment;

NOW THEREFORE, the Council of the Regional Corporation enacts as follows:

  1. That Tratod Properties Inc. is hereby authorized to maintain the Encroachment upon the public highway known as Regional Road 22 (Old Church Road), as described herein and in accordance with the terms and conditions contained in the Encroachment Agreement attached as Schedule "A" dated the 22nd day of July, 2014 between The Regional Municipality of Peel and Tratod Properties Inc., and shown on a drawing filed in Region of Peel Real Estate File ENC-12022;

  2. That Schedule "A" attached to this by-law be included and shall be considered part of this By-law;

  3. That the Encroachment Agreement be executed on behalf of the Regional Corporation by the Regional Clerk.
