A by-law to provide for the Regional Corporation’s consent to permit an encroachment onto parts of Regional Road 9 (King Street) in the Town of Caledon.

WHEREAS Alliance Agri-Turf Inc., the owner of the lands and premises described as Part of Lot 11, Concession 5, former Township of Albion as in Instrument VS105763, Town of Caledon, has requested permission to maintain and use certain structures or improvements upon the public highway (the “encroachment”);

AND WHEREAS pursuant to Section 11(3) of the Municipal Act, 2001, S.O. 2001, c.25, the Regional Corporation may pass a By-law respecting encroachments on Regional roads;

AND WHEREAS the Council of the Regional Corporation has by resolution passed on the 28th day of February, 2013 authorized the enactment of a by-law authorizing the encroachment;

NOW THEREFORE, the Council of the Regional Corporation enacts as follows:

  1. Alliance Agri-Turf Inc. is hereby authorized to maintain the encroachments upon the public highway known as Regional Road 9 (King Street), as described herein and in accordance with the terms and conditions contained in the Encroachment Agreement attached as Schedule “A” dated the 28th day of February, 2013 between The Regional Municipality of Peel and Alliance Agri-Turf Inc., and shown on drawing labelled 8112 King Street West – File Number 1529-5, dated May 16, 2012 and revised October 2, 2012, prepared by Riepma Consultants Inc. and retained in Region of Peel Real Estate File ENC-12146 with the Region;

  2. That Schedule “A” attached to this By-law is included and shall be considered part of this By-law;

  3. That the Encroachment Agreement be executed on behalf of the Regional Corporation by the Regional Clerk;
