|THE REGIONAL MUNICIPALITY OF PEEL|
|BY-LAW NUMBER 111-2007|
A by-law to provide for the Regional Corporation’s consent to permit an encroachment onto parts of Regional Road 19 (Winston Churchill Boulevard) in the City of Brampton.
WHEREAS Maple Lodge Farms Ltd., the owner of the lands and premises described as Part of Lot 2, Concession 6 West of Hurontario Street, City of Brampton (formerly Township of Chinguacousy), Regional Municipality of Peel, designated as Parts 1 and 2 on Reference Plan 43R-16571, has requested permission to maintain and use certain structures or improvements upon the public highway (the “encroachment”);
AND WHEREAS pursuant to Section 11(3) of the Municipal Act, 2001, S.O. 2001, c.25, the Regional Corporation may pass a by-law respecting encroachments on Regional roads;
AND WHEREAS the Council of the Regional Corporation has by resolution passed on the 4th day of October, 2007 authorized the enactment of a by-law authorizing the encroachment;
NOW THEREFORE the Council of the Regional Corporation enacts as follows:
1. That Maple Lodge Farms Ltd. is hereby authorized to maintain the encroachments upon the public highway known as Regional Road 19 (Winston Churchill Boulevard), as described herein and in accordance with the terms and conditions contained in the Encroachment Agreement dated the 5th day of February, 2007 between The Regional Municipality of Peel and Maple Lodge Farms Ltd. and as shown on the drawing titled Schedule “D” Agreement Plant and filed in Region of Peel Real Estate File ENC-07093.00.
2. That Schedule “A” attached to this by-law is included and shall be considered part of this By-law.
3. That the Encroachment Agreement be executed on behalf of the Regional Corporation by the Commissioner of Corporate Services and the Regional Clerk and the corporate seal affixed thereto.
