|THE REGIONAL MUNICIPALITY OF PEEL|
|BY-LAW NUMBER 47- 2004|
A by-law to provide for the Regional Corporation's consent to permit an encroachment onto parts of Regional Road 1 (Erin Mills Parkway) in the City of Mississauga.
WHEREAS The Credit Valley Hospital, the owner of the lands and premises described as Parcel 14-4, Section 43-1003, being Part of Lots 14 and 15 on Registrar's Compiled Plan 1003, Part of the Road Allowance between Concession 2 North of Dundas Street and Range 5 North of Dundas Street, Closed by By-law 446-74, City of Mississauga, Regional Municipality of Peel, designated as Part 1 on Reference Plan 43R-10237, save and except Parts 2, 3, 5, 6 and 9 on Reference Plan 43R-19032, has requested permission to maintain and use certain structures or improvements upon the public highway (the "encroachment");
AND WHEREAS pursuant to Section 11(2) of the Municipal Act, S.O. 2001, c.25, the Regional Corporation may pass a by-law respecting encroachments on Regional roads;
AND WHEREAS the Council of the Regional Corporation has by resolution passed on the 24th day of June, 2004 authorized the enactment of a by-law authorizing the said encroachment;
NOW THEREFORE the Council of the Regional Corporation enacts as follows:
1. The Credit Valley Hospital is hereby authorized to maintain certain encroachments upon the public highway known as Regional Road 1 (Erin Mills Parkway), as described herein and in accordance with the terms and conditions contained in the Encroachment Agreement dated the 16th day of March, 2004, between The Regional Municipality of Peel and The Credit Valley Hospital, with respect to the widened limits of Erin Mills Parkway as shown on drawing #20-04012-001 prepared by Marshall Macklin Monaghan Ontario Limited.
2. That Schedule "A" attached to this by-law is included and shall be considered part of this By-law.
3. That the Encroachment Agreement be executed on behalf of the Regional Corporation
by the Regional Solicitor and the Regional Clerk and the corporate seal affixed
