|THE REGIONAL MUNICIPALITY OF PEEL|
|BY-LAW NUMBER 56-2002|
|A by-law to provide for the Regional Corporation's consent to permit an encroachment onto parts of Regional Road 9 (King Street) in the Town of Caledon.|
WHEREAS Peel District School Board, the owner of the lands and premises described as Part of Lot 11, Concession 3, Town of Caledon, Regional Municipality of Peel (formerly in the Township of Albion) and municipally known as 7280 King Street, has requested permission to maintain and use certain structures or improvements upon the public highway;
AND WHEREAS pursuant to,
Section 308 (3) of the Municipal Act, R.S.O. 1990, Chapter M.45, as amended,
the Regional Corporation may permit encroachments onto Regional roads;
AND WHEREAS the Council of the Regional Corporation has by resolution passed on the 31st day of October, 2002 authorized the enactment of a by-law authorizing the said encroachment;
NOW THEREFORE the Council of the Regional Corporation enacts as follows:
1. Peel District School Board is hereby authorized to maintain certain encroachments upon the public highway known as Regional Road 9 (King Street), as described herein and in accordance with the terms and conditions contained in the Encroachment Agreement dated the 13th day of August, 2002, between the Regional Municipality of Peel and Peel District School Board, with respect to Part of Lot 11, Concession 3, Town of Caledon, Regional Municipality of Peel (formerly in the Township of Albion).
2. That Schedule "A" attached to this by-law is included and shall be considered part of this By-law.
3. That the Encroachment Agreement be executed on behalf of the Regional Corporation by the Regional Solicitor and the Regional Clerk and the corporate seal affixed thereto.
